Category: Legal Capacity to Contract Marriage

A Certificate of Legal Capacity to Contract Marriage (LCCM) is issued ONLY to Filipinos presently residing in Japan wishing to get married to a foreign national. Personal appearance of the Filipino applicant and foreign national fiancé / fiancée is required.

 

REQUIREMENTS FOR DIVORCED FILIPINO: (WITH PHIL. COURT RECOGNITION)

  1. Duly accomplished application form – may be downloaded from the Embassy website.
  2. Valid Passport: Original and one (1) photocopy of the data page.Note: If Expired Passport / Lost Passport / Mutilated Passport / Tampered Passport / Passport with Discrepancy, the applicant must apply for a new passport before applying for LCCM.
  3. NSO Birth Certificate: Original and one (1) photocopy.
  4. NSO Advisory on Marriage: Original and one (1) photocopy.
  5. Annotated NSO Marriage Certificate: Original and one (1) photocopy.
  6. Judicial Recognition of Foreign Divorce issued by a competent Philippine Court with Certificate of Finality. This must be authenticated by the DFA. Original and one (1) photocopy
  7. If former spouse is Japanese, please submit Family Registry (Koseki Tohon) reflecting the couple’s place and date of divorce. Please note that the Koseki Shohon (part of Koseki Tohon) and Certificate of Acceptance (Juri Shomeisho) are not acceptable.
  8. If former spouse is a foreign national other than Japanese, please submit Certificate of Acceptance of Divorce (Juri Shomeisho) showing the couple’s place and date of divorce.
  9. Residence Card: Original and one (1) photocopy.
  10. Three (3) passport size photos.

 

REQUIREMENTS FOR JAPANESE

1. Family Registry (Koseki Tohon). Validity is three (3) months from the date of issue.

 

  • If the Japanese is divorced, the record of marriage and divorce with the previous spouse must be indicated in the Koseki Tohon.
  • If the Japanese is widowed, the record of death of the previous spouse must be indicated in the Koseki Tohon.
  • A Koseki Shohon is NOT acceptable.

 

2. Valid Passport or any valid ID.

 

3. Three (3) passport size photos.

 

REQUIREMENTS FOR FOREIGN NATIONAL OTHER THAN JAPANESE

  1. A Certificate of Legal Capacity to Contract Marriage (LCCM) or its equivalent from his or her respective Embassy or Consulate. It must be in English.
  2. For US military personnel based in Japan, Authorization to Marry from his or her commanding officer is required.
  3. Valid Passport or Military ID.
  4. Three (3) passport size photos.

    3. If the deceased spouse is a foreign national other than Japanese, please submit death certificate issued by his or her Embassy or Consulate. It must be in English.

ADDITIONAL REQUIREMENTS: For applicants 18 to 25 years old:

  1. Between 18 to 20 years old – Affidavit of Parental Consent (with passport copy of parents).
  2. Between 21 to 25 years old – Affidavit of Parental Advice (with passport copy of parents) or Sworn Statement that parental advice was sought. Note: Affidavits coming from the Philippines must be notarized by a notary public in the Philippines and authenticated by the DFA. If parents are residing in Japan, the parents may apply for affidavit of consent or parental advice at the Embassy. If the parents are deceased, please submit NSO death certificate.
